A proposal for amendments in the legislation concerning the Council of Europe Convention on Cybercrime was finalized on February 5, 2005. The Legal uathorities are currently preparing a draft legislation.

The following provisions of the Criminal Code may be applicable:

Illegal access
§ 257a - Damaging and misusing records in information stores.
The mere access to the computer system is not a crime, but criminal responsibility may be applicable according to Section 257a.

Illegal interception
The transmission of communication from one computer to another may be punishable according to Section 239 as violation of privacy of transmitted messages.

Data interference
Section 257a may be applicable.

System interference
Section 257a may be applicable

Misuse of devices
The criminalization of such conduct is limited to preparation of especially serious criminal offences, and to complicity or participation in an attempt or completed criminal offence. In the course of implementation it appears to be necessary to consider new legislative regulation.
